Accor Economy Lodging, Inc., 347 F.3d 672 (7th Cir. 2003), two hotel guests had stayed at a “Motel 6" chain hotel in downtown Chicago, Illinois that was infected with Bedbugs. There was evidence presented at trial that the hotel chain knew of the infestation problem and continued to rent infected rooms to unsuspecting guests. A jury returned a verdict in favor of the hotel guests and awarded each guest the sum of $5,000.00 in compensatory damages and awarded each guest the sum of $186,000.00 in punitive damages. This jury verdict was affirmed by the United States Seventh Circuit Court of Appeals which sits in Chicago, Illinois.

Your Ounce of Prevention Pest Control - with no known address- arrived late, and did a 2.5 min review and said
"yes you have them"...... and walked out, nothing further was said.
I listened to the intercom
as George was on his way out and the pest dude said
"I was worried that you were okay"
what ever that meant?"
and ....... then the pest dude said,
" We have to get rid of HIM"
" what big ears you have grandmother said little red riding hood" ..... you-never know when someone is listening.

Other than what your page of requirements are that you sent on to me - the plan of action is ambiguous.
I look forward to what we plan to do and when, and if I will be allowed enough time to prep the area and and hire workers to help me for the list is extensive and im too ill to do it all by myself. I AM DISABLED AND PROTECTED BY THE ADA.
As your aware , this infestation is not of my doing and one of WTR and one that was kept stealth, from tenants of our building therefore only causing the issue to become worse, and spread to other tenants if indeed others have complained yet.
Perhaps Orkin may be the correct company to correct this issue, for the rapid and quick and non informative review by OUNCE OF PROTECTION pest control only raises an question of how dedicated they really are to this issue - who walks out of an apartment and says nothing to the tenant regarding a course of action?
I do not believe the process WILL BE genuine after those remarks, and will pass that on to my attorney and the ITU.
I look forward to to your reply- and tell you pest control dude to make sure he's not by an intercom next time he spouts off remarks that are derogatory ( what a dummy) what a ship of fools.

I will see you on Friday AUG 12 2011 - as you have outlined ( the whole day is a bit outrageous 9- 5 pm ) - but the infestation is from WTR, AND OTHER TENANTS THAT HAVE VACATED and your secret KNOWLEDGE OF THIS ISSUE - that you have not disclosed to the building tenants therefore you are responsible for the issue and your prior knowledge under law holds you in violation-of the law, not me.

WTR will be held culpable because along with other reasons WTR knowledge ( hence the fumigation of the hallway ) placed you in the best situation and position to prevent harm to your tenants, therefore you are guilty of the crime of non compliance and THEREFORE placing me and others in harms way for - bodily injury - personal injury- BATTERY and other issues that will come out as we move forward , this will end up in court. I WILL SUE YOU ON THIS ISSUE.

RIGHT AFTER THEY FUMIGATED A HALLWAY
I HAVE LIVED HERE FOR 6 YEARS AND NEVER IN MY LIFE AND IM 51 FACED A PROBLEM LIKE THIS.
I called you Monday and left you a voice mail to set up a time for the exterminator to spray. Please let me know when you can have your apartment prepared. Attached are instructions to properly prep your apartment.

Hello Amy Yoder with Water Tower Reality
-When we first met after the bug people arrived and went , when the bald man well built exterminator who took my can of Raid from me - came in he said to me.... one of the very first questions was
ANY PROBLEMS? and that was followed immediately with " any bed bugs" , roaches etc...
but his first words were BED BUGS.
well I said no for it was true in my whole tenancy here at 6654 I have never had an issue - mice, silverfish and spiders- that was the gamete for me.
Last week when I came home at mid day at or around 3pm- the whole hallway smelled of a biochemical vapor and the common area retained this very strong smell for a day or so and then it dissipated.
AS of last night , 07 29 2011- I am coughing up dark yellow thick Phelem and I am bitten beyond belief.
It is proven that respiratory issues arise and when a building has a bed bug issue , and the use of chemical treatment is applied - often more than one chemical at the same time, I under stand this type of a problem is now an epidemic in Chicago and very hard to contain. - when the chemicals are used the bugs go else where as stated from research that I did last night on the net- - I am cleaning up the area around my bed immediately, however I have never had this issue and after connecting the dots, it is clear that this issue is related to that smell , if indeed the hallways were fumigated - the carpet is filthy, smells and torn ( threadbare) and rotten in areas - therefore it presents a trip hazard. as stated in my list of repairs submitted to Fl mgt inc- many years ago.
I pray that this issue is brought under control as fast as your men can work.
I am waiting for the email or call about the other issues we spoke about and sent on to you via email last week - and to see if your man is seeing me on Monday- and now we have this new issue ...good lord.
So I am waiting for a call or letter -with baited breath.

how do you get rid of bed bugs?
Answer: At this time we are not very good at curing bed bug problems. There is no pesticide or application method that works 100 percent of the time. Depending on the clutter that may exist in each apartment, treatment can have variable success. Bed bugs are very tough and the more clutter there is, the easier it is for bed bugs to hide away from the treatment. Sanitation efforts on the part of the resident may need to be extreme to get good bed bug control. So bed bug management requires just as much cooperation from the occupants as from the management and pest control company.
Actual treatment requires patience and persistence. Treatment usually requires multiple products being applied at least 3 times at 2 week intervals.
So, bottom line: treating an entire building will require all tenants and management to join in a cooperative, ongoing to inspect for bed bugs on a regular basis and keep sanitation levels high so that bed bugs problems do not get established.
