Frustrated and Victimized on 12/30/2011
While residing at the south-side basement suite of 7233 Dow Avenue in Burnaby, British Columbia (Dec, 2010 to March, 2011), my roommate discovered what he suspected to be a bedbug in his room (Feb, 2011). As soon as we were sure they were bed bugs, we notified the landlord immediately and made every attempt within our means to contain the situation and minimize the severity as they were only confirmed, by professionals, to be in his room.
Without any apparent concern for our safety, the landl
ord insisted on toxic fumigation without exploring any safer options, based on a random number he admittedly pulled from the phone book. Then he handed us a bill for the entire cost totaling $730, even though he had no grounds for placing liability. We proved to be cooperative and expressed a willingness, in writing, to talk and work out a fair solution that everyone could agree to, but because that involved a cost on his part, he wanted nothing to do with it. He had decided we were guilty, end of story for him.
After the first treatment (late February) the landlord, as per the pest control professional's instructions, was required to follow up with a second treatment to kill any unhatched eggs 10-14 days after the initial treatment. Because both my roommate and I decided to move out, the landlord postponed the second treatment until we moved out almost 5 WEEKS LATER, thereby rendering the first treatment ineffective (This is the same treatment he's trying to charge us with). This postponement also increases the likelihood of driving the bed bugs out of the treated room and spreading to other areas of the house! He even tried to charge me for an extra month, blaming me for not being able to rent out the unit, only because HE postponed the follow-up treatment, which would have been done had he complied with the professional's instructions!
From the second of learning about the bed bug issue the landlord continued to project blame on us and deflects any responsibility for his own property. After we both moved out he unlawfully refused to return our damage deposits, without any proof we introduced them, and continues to defy court orders to return my deposit.
Despite being able to recuperate any losses by increasing the rent a modest amount, he has attacked me personally using the Residential Tenancy Board for the full amount of fumigation ($730), on top of already keeping both of our deposits totaling almost $500. Having lost his case against me and continuing to defy a court order, he's now going after my previous roommate, who is on a disability pension and has to frequent food banks just to eat. (FYI: This landlord has a corvette and a jaguar sitting in his back yard that he doesn't even use!)
During this entire ordeal he continues to demonstrate his character by victimizing us, making false accusations, and insisting my roommate and I pay for the entire cost of fumigation. Although I have no proof, to this day he has never denied the existence of an insurance policy that covered the costs of pest control, despite my repeated inquiries.
To the best of my knowledge, I am uncertain if the landlord scheduled the second treatment, but has since rented the unit (May 1, 2011). Regardless, in waiting so long for a second treatment he has put the poor tenant(s) who moved in after us at risk of being infected with bed bugs. Knowing the type of person the landlord is I highly doubt he disclosed the bed bug incident to the current tenant because the only thing he cares about is getting paid.
BEWARE!!! This landlord is a slumlord in the truest sense of the word. Don't be foolishly drawn in by the nice property and his seemingly "innocent" nature. They've been unfairly accusational, negligent in adhering to tenancy laws, defiant against court orders, uncooperative and routinely violated our privacy during our tenancy by electronically monitoring every window and door whenever they were opened as well as watching our guests come and go (They lived above us in a three story house).
I am still fighting this slumlord in court (9 months later) to have my deposit rightfully returned to me, yet he still spits in the face of the same authority that grants him license to rent his suites.
